These terms are between you and Ansure (“Ansure,” “we,” “us”). By accessing or using this website or our product, you agree to be bound by these terms and by our Privacy Policy. If you do not agree, do not use the website or the product.

If you use Ansure on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.

We may revise these terms from time to time. Changes take effect when posted, and your continued use after that means you accept them. We will revise the effective date at the top of this page when we make changes.

You agree not to: violate any applicable law or regulation; interfere with or disrupt the website, product or connected systems; attempt to gain unauthorized access to any account, system or data; introduce malware or other harmful code; use any robot, scraper or automated means to access or copy the site except as we permit; impersonate any person or entity; or infringe the rights of others.

We may investigate and take appropriate legal action against anyone who violates this section, including suspending or terminating access and cooperating with law enforcement.

Your agency retains ownership of the data it loads into the product. We process that data on your behalf to provide the product, subject to our Privacy Policy and any data processing or commercial agreement signed between the parties.

Access to the product is typically provided under a separate order form or commercial agreement that sets out fees and payment terms. Unless that agreement says otherwise, fees are exclusive of taxes, which are your responsibility except for taxes on our net income.

Any additional terms in such an agreement are incorporated here by reference; if they conflict with these terms, the commercial agreement governs.

Our total liability for any claim arising out of or related to these terms will not exceed the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or one hundred US dollars (US$100). This does not affect liability that cannot be limited under applicable law.

You agree to defend, indemnify and hold harmless Ansure and its affiliates, and their officers, directors, employees and agents, from any claims, damages, losses and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these terms or your misuse of the website or product.

These terms apply while you use the website or product. We may suspend or terminate your access at any time, with or without notice, including for any violation of these terms. Provisions that by their nature should survive termination — such as intellectual property, disclaimers, limitation of liability, indemnification and governing law — will survive.

Any claim arising out of or related to these terms or the website must be filed within one (1) year after it arises; otherwise it is permanently barred, to the extent permitted by law.

These terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules, unless a signed commercial agreement specifies otherwise.

You agree that any dispute will be brought exclusively in the state or federal courts located in the State of Texas, and you consent to their jurisdiction and venue.

Our failure to enforce any provision is not a waiver of it. If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary, and the rest of these terms will remain in effect.

These terms, our Privacy Policy, and any commercial agreement incorporated by reference are the entire agreement between you and Ansure regarding the website and product, and supersede any prior understandings. Where a commercial agreement conflicts with these terms, that agreement governs.
